The Constitutional Court ruled that there had been a procedural violation in Abdulkadir Eken’s application alleging that he had been tortured while in custody in the village of Mezrik, in the Çınar district of Diyarbakır, in 2019, on the grounds that an effective investigation had not been conducted. Despite the judicial reports, the Constitutional Court rejected the claim of ill-treatment on substantive grounds, arguing that the material evidence was insufficient. The Court ordered the payment of 50,000 TL in moral damages to Eken. The decision was taken by a majority vote.
