14 years have passed since the death of 12-year-old Uğur Kaymaz and his truck driver father, Ahmet Kaymaz, who were shot dead by the police in front of their house in Kızıltepe district of Mardin. Their death was attempted to be reflected on the media as “Terrorists in preparation for protest” with the gun that was left next to them after being killed with 13 bullets. Despite the long time that passed, the case is still not illuminated.
Mother Makbule Kaymaz indicated that she is having the pain of her son and husband’s death on each anniversary. “We only want justice. We want peace. However, we can’t see anything other than tyranny and pressure against our demands. We have never forgotten that day; we never could. We don’t have faith in justice anymore,” Kaymaz said.
The lawsuit filed against four police officers concluded with acquittal due to “self defense” in Eskişehir, where it was transferred due to ‘security reasons.’ The verdict was later approved by the 1st Criminal Chamber of the Court of Cassation. The file was carried to the European Court of Human Rights and Turkey was sentenced to pay 140 thousand Euros of compensation due to a violation of “the right to life.” Following the ECtHR decree, Human Rights Association (IHD) Mardin applied to Eskişehir 1st Assize Court for retrial. The application was denied without presenting a reason. The file was carried to the Constitutional Court in 2015, and still awaits a verdict.
