The lawsuit of compensation filed by lawyer and human rights advocate Nurcan Kaya was concluded after she was detained at the airport in October 2019 within an investigation opened against her due to “public incitement towards resentment and hostility” through her social media posts. The court claimed that the financial damage couldn’t be calculated exactly as lawyers do not work on the means of monthly salary and decided that Kaya hasn’t faced financial damage. However, the court accepted Kaya’s claim for moral compensation and issued 250 Turkish Liras of moral compensation to be paid to her.
Undertaking Kaya’s defense, Media and Legal Studies Association (MLSA) Co-Director and lawyer Veysel Ok indicated that their purpose in filing this lawsuit wasn’t financial gain but to prevent the judiciary from issuing unrightful and unlawful warrants and to see that they take responsibility for wrong decisions they make. Ok stated, “The judicial decision was 250 Turkish Liras of compensation, as if to mock the case. We will carry this matter to the Constitutional Court as well. We want to show that lawyers who are also rights advocates will not be scared off with such investigations.” Kaya had been released on the conditions of judicial measures and a travel ban against her after testifying at the airport; and the investigation conducted against her had been concluded with non-prosecution on June 8, 2020.
