The Constitutional Court ruled that the freedom of expression of student Erhan Urak, who was convicted of “making terrorist organisation propaganda” due to folk dancing and chanting slogans in some meetings and demonstrations he attended, was not violated.
Evaluating the decision, Batman Bar Association President Erhan Şenses stated that the precedent of the European Court of Human Rights (ECtHR) in the case of Ömer Faruk Akyüz vs. Turkey was a decree of violation despite the postponement of the six-month imprisonment sentence issued against him due to chanting the slogan, “Long Live President Apo”. Şenses further explained that the Constitutional Court decree did not meet the requirements of the ECtHR.
