In the application of lawyer Ramazan Demir, who was beaten by the police and was attempted to be detained with reverse handcuffs in the protest organized by his colleagues at Istanbul Çağlayan Courthouse regarding Contemporary Lawyers’ Association (ÇHD) member lawyers being detained with an operation in 2013, the Constitutional Court decided that the “the inhumane treatment ban was violated through a physical and procedural way,” sentencing 40 thousand TL of compensation to be paid to Demir. The criminal complaint made by the lawyer on the torture has been concluded with non-prosecution. The high court stated that in case Prosecutor’s Offices do not effectively investigate such incidents, an active immunity will start for public officers.
