The three-year prison sentence issued against defendant soldier Hakan Alkan in the trial of 18-month-old Mehmet Uytun, who was shot to death with a tear gas shell on the balcony of his house in Cizre, Şırnak in 2009 as he was in the arms of his mother, was commuted to a fine of 18,200 TL.
As the Cizre District Governorate did not authorize an investigation on the incident, the case could only be opened 11 years after Uytun’s death. After the lack of the investigation permission, the objection made by the lawyers to the Diyarbakır Administrative Court on August 31, 2012, was rejected. With the rejection decree of the Administrative Court on December 4, 2012, the Cizre Chief Public Prosecutor’s Office issued a verdict of non-prosecution regarding the incident on January 14, 2013.
