In the application of Serhat Ölğen from Diyarbakır, who was injured with a tear gas shell in front of his house during a protest and was later beaten and detained by the police, the Constitutional Court (AYM) decided that the mistreatment ban was violated. In its reasoned decree, the High Court pointed out that the Prosecutor’s Office didn’t investigate mistreatment allegations against the police, didn’t collect evidence and didn’t take any legal action, sending the file to Diyarbakır Chief Public Prosecutor’s Office for re-investigation in order to eliminate the consequences of the violation.
